I. General Provisions

1.1 Identification of the Provider

The electric bicycle rental service presented on the website www.bike.city is operated by:

Hereinafter referred to as “Bike.City” or the “Provider”.

1.2 Definitions

For the purposes of these General Terms and Conditions (hereinafter referred to as “T&C”), the terms below have the following meanings:

  • “Client” — the person (tourist/consumer) or company that makes a booking and uses Bike.City services;
  • “Consumer” — any individual acting for personal use, outside of their business or professional activity, as defined by Romanian law (GEO 34/2014 and Law 193/2000);
  • “Electric Bicycle” (or “E-bike”) — a pedal-assist bicycle (pedelec) with a maximum motor speed of 25 km/h, provided by Bike.City for rent;
  • “Accessories” — gear provided with the e-bike: helmet, keyed lock, frame lock, phone holder, front and rear lights, luggage rack, and kickstand;
  • “Rental Period” — the agreed time between picking up and returning the e-bike, as stated in your booking confirmation;
  • “Security Deposit” — the €100 amount per booking, either blocked on your card or paid in cash as a guarantee during the rental, which is returned as described in Chapter V;
  • “Booking” — the order placed via bike.city or direct contact and confirmed by email; one booking can include up to 4 e-bikes;
  • “Hotel delivery” — the service where we deliver and pick up the e-bike at your location in Bucharest for a €15 fee;
  • “Pickup from office” — when you collect and return the e-bike yourself at our office: 58 Valea Lungă Street, Sector 6, Bucharest (free of charge);
  • “Handover-Receipt Report” (“HRR”) — the document (paper or digital) that records the condition of the e-bike when you receive it and when you return it;
  • “Total Loss” — when the e-bike is destroyed or lost and cannot be repaired or recovered;
  • “Partial Damage” — any damage to one or more parts of the e-bike that can be fixed;
  • “Normal Wear and Tear” — minor, unavoidable marks or signs of use resulting from normal and proper riding of the e-bike.

1.3 Object of the Contract

These T&C set the rules for how Bike.City rents out electric bicycles and their accessories for a specific period of time.

By finishing a booking and/or taking the e-bike, the Client confirms they have read, understood, and fully accepted these T&C. You show your agreement either by ticking the box on www.bike.city or by signing the handover document that refers to these terms.

1.4 Legal Basis

These T&C are drafted in accordance with applicable Romanian and European law, in particular:

Romanian Civil Code (Law no. 287/2009) — the legal regime of leases;

Law no. 193/2000 on unfair terms in contracts concluded between professionals and consumers, republished;

  • Government Ordinance no. 21/1992 on consumer protection, republished;
  • Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals;
  • Regulation (EU) 2016/679 (GDPR) on personal data protection;
  • Government Emergency Ordinance no. 195/2002 on road traffic, republished.

II. Services Offered

2.1. Hotel delivery

Bike.City delivers the e‑bike to your chosen location (hotel, house, apartment, or guesthouse) in Bucharest and picks it up at the end of your Rental Period.

  • Fee: €15 per booking (covers both delivery and pickup)
  • Area: Anywhere within Bucharest Municipality
  • Scheduling: Delivery and pickup will take place during the time slot agreed when you made your booking

2.2. Pickup from office

The Client collects and returns the e‑bike at the Bike.City operational point: 58 Valea Lungă Street, Sector 6, Bucharest.

  • Fee: Free of charge
  • Schedule: According to the opening hours shown on our website or as agreed by phone.

III. Prices, Rates and Payment

3.1. Rates

Rental rates are displayed on www.bike.city and are quoted in EUR and/or RON, VAT included. The price that applies to a booking is the one shown on the website at the time the booking is made; any later price changes do not affect bookings that have already been confirmed.

3.2. Payment Methods

  • Credit/Debit card online — via the secure payment processor integrated on our website, www.bike.city.
  • Cash — only available for the "Pickup from office" option, at the time you collect the e-bike.

3.4. Invoicing

At the Client's request, Bike.City issues a tax invoice either electronically (by email) or on paper, in accordance with applicable tax law.

3.5. Currency and Exchange Rate

All prices, fees and the Security Deposit are expressed in EUR, the reference currency of the service. Payment may be made in EUR or in RON. Where payment is made in RON or the card is charged in RON, the conversion is performed at the exchange rate applied by the payment processor or by the Client's issuing bank on the actual transaction date. Any exchange-rate differences, currency-conversion or transaction fees charged by the Client's bank are borne by the Client and are not attributable to Bike.City.

For cash payments at our premises, the reference amount is the one in EUR. If the Client pays in RON, the conversion is made at the reference exchange rate of the National Bank of Romania (BNR) on the day of payment.

IV. Booking and Confirmation

4.1. Booking process

Bookings can be made via the website (www.bike.city), by email ([email protected]) or by phone/WhatsApp (+40 734 818 529). A booking may include up to 4 electric bicycles.

4.2. Required Information

To complete a booking, the Client must provide:

  • Full name;
  • Email address;
  • Telephone number (with international prefix);
  • Delivery address (for Hotel delivery);
  • Desired pick-up and return dates and times;
  • Number of electric bicycles.

Before handover, the Client must send a copy of a valid identity document (ID card or passport) and present the original document at handover for verification.

4.3. Confirmation

A booking is considered confirmed once the Client receives a confirmation email from Bike.City. This email confirmation represents your agreement to these T&C and serves as a legal contract.

4.4. Changing your Booking

The Client may request to change their booking (date, time, or number of bikes) at least 24 hours before the scheduled handover, depending on availability. Any changes only become official once you receive a written confirmation (by email) from Bike.City.

V. Security Deposit

5.1. Deposit Amount

€100 (one hundred euros) per booking, regardless of how many e-bikes are rented within that same booking (one booking can include up to 4 e-bikes).

5.2. How the deposit is paid

At the Client’s choice, the deposit can be made either by credit/debit card pre-authorization (blocking the amount without taking it from your account) or in cash at the moment the e-bike is handed over to you.

5.3. Return of the Deposit

The deposit is returned in full if the e-bike and accessories are returned in good condition (normal wear excepted) and no damages or missing items are found:

  • Cash deposit: returned in full on the spot at the time you return the e-bike.
  • Card pre-authorization: Bike.City releases the hold immediately after the bike is returned; the issuing bank may take 3–7 business days to process and show the amount back on your account — this timing does not depend on Bike.City.

5.4. Retention of the Deposit

Bike.City may withhold from the Deposit only amounts that are proportional to proven actual loss, in the following situations:

  • damage to the e-bike or accessories, agreed upon and assessed according to Chapter IX;
  • missing accessories at return;
  • traffic fines incurred during the Rental Period that are the Client’s responsibility;
  • unreported late return, as described in Chapter XII.

Withholding is not automatic and is not a flat penalty: Bike.City will inform the Client of the reason and the amount, and will provide supporting documents.
If the proven damage exceeds the Deposit, the Client must pay the difference within 7 days of notification; if the proven damage is less than the Deposit, the remaining amount will be returned.

VI. Cancellation and Refund Policy

Cancellations must be sent in writing to [email protected] or communicated by phone at +40 734 818 529.

6.2. Refunds

Refunds are processed using the same payment method you used for your booking, within a maximum of 14 calendar days from the moment the cancellation is confirmed.

6.3. Cancellation by Bike.City

Bike.City may cancel a booking for valid reasons (such as e-bikes being unavailable due to force majeure, or extreme weather conditions that put the Client's safety at risk). In this case, the Client is entitled to a full refund (100%) or a free rescheduling, whichever they prefer.

6.4. Right of Withdrawal (distance contracts)

Under art. 16 letter (l) of Emergency Ordinance no. 34/2014, the electric bicycle rental service is a leisure service linked to a specific date or period, so the 14‑day right of withdrawal that applies to distance contracts does not apply. This exception is clearly brought to the Consumer’s attention before the booking is confirmed. The cancellation policy in art. 6.1 still applies independently as a commercial gesture.

VII. Handover and Receipt of the Bicycle

7.1. Handover-Receipt Report

At handover, Bike.City and the Client will complete a Handover-Receipt Report (HRR) that records:

  • the e-bike identification (model, serial number);
  • the general technical condition;
  • the battery level;
  • the condition of the accessories;
  • any pre-existing damages or defects.

The report can be prepared either in physical (paper) format or digitally (with an electronic signature).

7.2. Photographs

At handover and return, Bike.City takes photographs of the e-bike. These photos are an integral part of the HRR and serve as evidence to assess the condition of the equipment.

7.3. Functional check

Before taking the e-bike, the Client must check together with a Bike.City representative that:

  • the battery and electric motor work;
  • the braking system works;
  • the lights work;
  • the gear shifter operates correctly;
  • the tires are in good condition;
  • the lock functions properly.

7.4. Signature

By signing the Handover‑Receipt Report (HRR), the Client confirms they received the e-bike and accessories in the recorded condition, were instructed on correct use, and have read and acknowledged these T&C.

7.5. Reporting defects

The Client must report any defect found after handover immediately by phone or WhatsApp at +40 734 818 529.
Defects not recorded in the HRR at handover and not reported may be charged to the Client at return only if Bike.City proves the defects occurred during the Rental Period and are the Client’s responsibility.

VIII. Client Obligations

8.1. Eligibility requirements

Minimum age: you must be at least 18 years old on the date of your booking. The Client must present a valid identity document (ID card or passport) at handover.

8.2. Traffic rules

The e-bikes provided by Bike.City are pedal-assist bicycles (pedelecs) with electric assistance limited to 25 km/h. Under Romanian law, a driving licence is not required for these vehicles.

The Client must comply with Emergency Ordinance no. 195/2002, including rules for cyclists (use cycle lanes where available; do not ride on sidewalks).

Third‑party motor liability insurance (RCA) is not required for these vehicles under current law. Wearing a helmet is recommended for all riders.

8.3. Proper Use

The Client must use the e-bike only for leisure and personal transport. You must ride on public roads, bicycle lanes, and suitable paths within the permitted area: Bucharest Municipality and Ilfov County.

8.4. Prohibitions

The Client is prohibited from:

  • using the e‑bike under the influence of alcohol, narcotics, or medication that impairs ability or reaction time;
  • taking the e‑bike outside the borders of Romania;
  • riding the e‑bike on unpaved or rough terrain (mountain trails, steep descents, rough off‑road ground);
  • carrying passengers on the e‑bike, except children in a dedicated child seat if the bike is properly equipped for it;
  • sub‑renting or handing the e‑bike over to third parties;
  • taking part in races, competitions or similar activities;
  • making technical modifications or repairs to the e‑bike;
  • exceeding the weight limit indicated by the manufacturer;
  • leaving the e‑bike unattended without securing it with the provided lock.

Failure to comply with any of these prohibitions makes the Client liable for direct damages proven by Bike.City, in accordance with Chapter IX.

IX. Liability for Damages

9.1. General principle

The Client is liable for damage to the e‑bike or its accessories that occurs during the Rental Period and is attributable to the Client, except for normal wear and tear and technical defects not caused by the Client. The Client’s liability covers the actual, proven loss, assessed under this chapter. Liability for indirect damages or loss of profits does not apply to Consumers.

9.2. Indicative price list for damages and spare parts

The amounts below are indicative maximum estimates of replacement/repair costs and are provided as a reference in case of a disputed assessment. The amount actually retained cannot exceed the real cost of repair or replacement, proven by documents (estimate, invoice).

9.3. Normal wear and tear

Not charged and considered normal wear and tear are: superficial scratches from normal use; wear of tyres and brake pads; dust or mud from weather conditions; and minor damages that are normal when using the e‑bike on public roads.

9.4. Damage assessment

Assessment is done at return, in the presence of the Client, by visual and functional inspection and by comparing with the handover photos and the Handover‑Receipt Report (HRR). The result is recorded in the return HRR. The Client has the right to contest the assessment and may request an independent expert report; the cost of that expert report is paid by the Client. Until the final amount is established, Bike.City may only withhold the undisputed amounts from the Deposit.

9.5. Payment for damages

If the proven damage amount is less than or equal to €100, it will be retained from the Deposit. If it exceeds €100, the Client must pay the difference within 7 days of receiving the notification accompanied by supporting documents.

X. Theft, Loss, Total Destruction

10.1. Reporting obligation

In case of theft, loss or total destruction, the Client must:

  • contact Bike.City immediately at +40 734 818 529;
  • file a report with the Romanian Police within 24 hours of discovery; and
  • send Bike.City a copy of the police report within 48 hours.

10.2. Financial responsibility

If the theft or loss is the Client’s fault, the Client is responsible for the replacement cost of the e‑bike, up to its real market value (indicatively €1,400, see art. 9.2). Bike.City may claim only the actual loss suffered.

10.3. Exception to liability

The Client is not liable if they can prove the theft or loss was not their fault — for example, if it happened because of a defect in the equipment provided by Bike.City (e.g., a faulty lock).

10.4. GPS tracking

Bike.City e‑bikes have GPS tracking devices (Samsung SmartTag) to help secure and recover bikes in case of theft. The Client is informed and consents to the use of this system during the Rental Period (details in Chapter XII).

10.5. Recovery

If the e‑bike is recovered fully functional within 30 days of the theft report, the Client pays only for any damages (if applicable) plus reasonable administrative costs up to €100. Any amount paid in excess will be refunded.

XI. Technical Failures and Assistance

11.1. Assistance contact

Bike.City provides technical assistance 24/7 by phone/WhatsApp at +40 734 818 529 and by email at [email protected].

11.2. Client obligations in case of a failure

The Client must report any failure immediately; stop using the e‑bike if it poses a danger; not abandon the e‑bike (secure it with the provided lock in the nearest safe place); and follow the instructions given by the Bike.City team.

11.3. Electrical failures

For failures of the electrical system (motor, battery, display, controller, pedal sensor), Bike.City will provide a replacement e‑bike free of charge, with a response time of up to 2 hours within Bucharest. The Client will not be charged for electrical failures that are not caused by improper use.

11.4. Punctures and minor mechanical breakdowns

For tyre punctures or minor mechanical faults, the Client may request Bike.City service (travel fee €10 per bicycle). The repair itself is free if the fault was not caused by the Client.

XII. Return and Final Inspection

12.1. Return location and time

The return must be made at the agreed location (Hotel delivery) or at the operational office (Pickup from office) at the time stated in the booking. The Client must inform Bike.City at least 2 hours in advance if returning early.

Before declaring the e‑bike unreturned, Bike.City makes reasonable attempts to contact the Client (phone, WhatsApp, email). The Client can avoid penalties by requesting an extension before the Rental Period expires (subject to availability and payment of the additional rate).

12.3. Final inspection, battery and cleanliness

At return, the e‑bike’s overall condition is checked, comparative photos are taken, and the return Handover‑Receipt Report (HRR) is completed. No fee is charged for the battery level. The e‑bike must be returned in a reasonably clean condition; normal rain or road mud/dust is acceptable. A cleaning fee of €20 applies only for excessive dirt (from unpaved terrain) that requires professional cleaning.

XIII. Personal Data Protection (GDPR)

13.1. Data Controller

HUCAMI COURIER SRL (Bike.City), with the identification details listed in art. 1.1, is the Data Controller.

13.2. Data collected and purpose

Bike.City processes the following personal data: identification data (name, nationality); contact data (email, phone); a copy of the identity document; payment data (processed only by a certified payment processor — Bike.City does not store card details); and temporary accommodation address (only for delivery).
Purposes: contract performance; invoicing and tax compliance; contacting you in emergencies; handling damages and disputes; and meeting legal obligations.

13.3. GPS location

Location data from GPS devices (Samsung SmartTag) are processed only for security and theft‑prevention purposes. These location data are not shared with third parties except with authorities upon lawful request, and they are deleted automatically 30 days after the e‑bike is returned.

13.4. Retention period

Data required for tax obligations are kept for 5 years from the end of the contractual relationship. A copy of the identity document is retained only for the strictly necessary period to manage possible damages or disputes and is deleted afterwards.

13.5. Data subject rights

You have the GDPR rights: access, rectification, erasure (the “right to be forgotten”, subject to legal retention obligations), restriction, portability, objection, and not to be subject to automated decision‑making. Send requests to: [email protected]. You may file a complaint with the Romanian data protection authority ANSPDCP. The full privacy policy is available on www.bike.city.

XIV. Limitation of Liability

14.1. Bike.City liability

Bike.City is liable for hidden technical defects of the e‑bike that existed at handover and could not be detected by ordinary inspection, as well as for defects that endanger the Client’s safety, in accordance with the lessor’s warranty obligations (art. 1786–1788 Civil Code).

14.2. Exclusion of Bike.City liability

Bike.City is not liable for accidents caused by the Client’s inattention or negligence, for damages resulting from failure to comply with these T&C or the instructions, for damage caused by improper use, for theft resulting from the Client’s negligence (e.g., failing to secure the bike with the provided lock), or for damage caused by third parties.

14.3. Limitation of amount

The total liability of Bike.City toward the Client is limited to the amount of the fare actually paid, except in cases of hidden defects that caused damage, gross negligence or fraud by Bike.City, and cases where liability is mandatory by law (in particular personal injury or harm to health). This limitation does not affect the Consumer’s mandatory legal rights. Legal basis: art. 1355 Civil Code.

Bike.City will notify the Client of any additional fee within 14 days of return, accompanied by supporting documents.

XVI. Force Majeure

Force majeure means any external, unforeseeable, absolutely insurmountable and inevitable event within the meaning of art. 1351(2) of the Civil Code (natural disasters, pandemics, government restrictions, armed conflicts). The obligations of the affected party are suspended for the duration of the event; the affected party must notify the other party within 24 hours. If the event lasts more than 15 days, either party may request termination of the contract without penalties. In that case, Bike.City will offer a full refund or a free rebooking, at the Client’s choice.

XVII. Final Clauses

17.1. Governing law

These T&C are governed by Romanian law, without affecting mandatory consumer‑protection rules that apply in the Consumer’s EU Member State of residence.

17.2. Dispute resolution

Disputes should be resolved amicably whenever possible. If no agreement is reached, disputes fall under the jurisdiction of the Romanian courts at Bike.City’s registered office and the contract is governed by Romanian law.
For Consumers domiciled in another EU Member State, EU rules on consumer protection still apply and allow them to sue or be sued in the courts of their own domicile; this clause does not remove that right.

17.3. Consumer protection

The Client may notify the National Authority for Consumer Protection (ANPC) and may use the Online Dispute Resolution (ODR) platform: https://consumer-redress.ec.europa.eu/.

17.4. Severability

If any clause is declared null or unenforceable (including as abusive under Law no. 193/2000), the remaining clauses remain in force. The invalid clause will be replaced by a valid provision that best reflects the original intention, within legal limits.

17.5. Changes to the T&C

Bike.City may update these T&C. Changes will be published on www.bike.city. The T&C that apply to a booking are those in force at the time the booking is confirmed; Clients with ongoing bookings will be notified by email.

17.6. Language

These T&C are available in Romanian and in English; both versions have the same content. The Consumer may rely on the version in the language in which the terms were presented and in which the contract was concluded. For business (corporate) clients, if there is any discrepancy the Romanian version prevails.
